Immigration Technicality May Keep Homecoming Queen From Graduation

Many individuals decide they can go it alone when it comes to green card applications or citizenship issues.  Their employer handles the work visa, and after that  they are home free.  No reason to pay a lawyer to get those remaining forms secured.  They can do it themselves.  After all, that's what their wife's cousin did.

Well contrary to the words of your wife's cousin.  Immigration issues can be tricky.  In fact, ABC news reported May 30, 2012 that an immigration law technicality may keep a homecoming queen from graduating from high school.  Senior classman,  Elizabeth Olivas thought she would be enjoying the last days at her Indiana high school with her classmates before graduating on Saturday.

Instead, the Frankfort High School homecoming queen is in her native Mexico, caught up in an immigration technicality that has her future in the United States straddled between U.S. government agencies, according to the Indianapolis Star.

Olivas has lived in the U.S. since the age 4, and her father is a naturalized U.S. citizen. But after turning 18, according to the law, she had 180 days to return to Mexico  to apply for a long-term visa to the United States. Without that visa she would become an illegal immigrant. So Olivas and her father took the trip down to the Juarez consulate, only to realize they were one day late.  Now she must wait three years before entering the country again, unless she receives a  ”humanitarian patrole” visa waiver. This however, does emphasize the importance of maintaining an ongoing relationship with an immigration attorney even after you receive a green card, or if all members of your family have not become citizens.  I frequently find that the do-it-yourself filers can have long term issues that can impact their family and their future.  Saving a few dollars in the short term can cause years of heartache and financial expense.  Ask Elizabeth Olivas.

Delay for I-129 Petitions


Due to the high number of recently filed I-129 petitions with USCIS, customers may experience a longer than usual period of time to receive a receipt notice from USCIS.  Usually, customers can expect to receive their receipt notice within 30 days of delivery confirmation.  However, due to an unexpectedly high volume of I-129 petitions, it may be an additional two to four weeks before customers receive a receipt notice.



Customers who do not receive notification of receipt of an I-129 petition within 60 days of their delivery confirmation date may contact the appropriate Service Center via the email addresses listed on the USCIS Web page.  This is a temporary situation and we apologize for any inconvenience this may cause.

Attorney Satveer Chaudhary Quoted in Star Tribune Regarding Canada Entry Denials

Chaudhary Law Office founder, attorney Satveer Chaudhary, was quoted yesterday, May 19th, 2012 in a Minneapolis Star Tribune articel about travel to Canada.  Earlier in the year Candadian authorities have stated that border patrols will have the option to allow those with minor infractions on their criminal records, that occurred more than 5 years ago, to apply for a one-time resident permit for entry into Canada.   The entry, however, is completely at the discretion of the border crossing officer.

The article states:

But meanwhile, those with multiple misdemeanor convictions or more serious offenses still have difficult hurdles to clear if they want to enter Canada.

"I continue to have a steady stream of people [seeking help]," said Satveer Chaudhary, a Fridley attorney and former state legislator. People can seek "criminal rehabilitation" status by filling out numerous forms and getting an FBI background check, which can take eight weeks to receive. Fingerprints also are required.

That process is lengthy, but if accepted, a person can enter Canada freely. "People make mistakes," Chaudhary said. "Most of those mistakes shouldn't be a lifelong yoke around your neck if you want to hunt and fish." His advice: Plan ahead. It can cost several hundred to several thousand dollars, depending on whether a person hires an attorney or not, to acquire criminal rehabilitation status.

Ultimately, those with criminal convictions will have to decide if they're willing to pay the money and spend the time jumping through those bureaucratic hoops, Chaudhary said. "I had that conversation with a fellow last week. He said, 'Well, I don't need to go to Canada that bad.'"
